Terms of Service

These Terms of Service ("Terms") govern your access to and use of Proxylang's website translation proxy service ("Service") operated by TITUS TIMOTHY DAVID, doing business as Proxylang ("Company," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Important: Please read Section 4 (Machine Translation Disclaimer) carefully. Our Service uses AI-powered machine translation which may not be 100% accurate.

1. Description of Services

Proxylang provides an automated translation proxy service that:

  • Intercepts web requests to your domain via DNS configuration
  • Translates text content using AI-powered machine translation
  • Caches translated content at edge locations globally for performance
  • Serves localized versions of your website to visitors based on language preferences
  • Provides SEO optimization including hreflang tags and localized URLs

The Service operates as a "pass-through" proxy. We do not permanently host your website content. Your original content remains on your servers, and we translate it in real-time or serve cached translations.

2. Account Registration

To use the Service, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Subscription and Payment

3.1 Subscription Tiers

We offer multiple subscription tiers (Free, Starter, Pro, Business) with varying limits on translation requests, tokens, domains, and languages. Current pricing and limits are displayed on our pricing page.

3.2 Billing

  • Paid subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • Failed payments may result in service suspension

3.3 Usage Limits and Overages

  • Free tier: New translations pause when limits are reached. Cached translations continue serving for 1 month from when you first started translating.
  • Paid tiers: New translations pause when limits are reached (no overage charges). Cached translations continue serving for 1 month after your billing period ends if your subscription is no longer active.
  • You will receive email notifications at 75%, 90%, and 100% of your usage limits

3.4 Quota Packs (Image and Search Translation Add-ons)

Image translation and search query translation are sold as prepaid quota packs, separate from subscription tiers. The following terms apply:

  • Validity period: All quota purchased on or after the effective date of these terms is valid for 12 months (1 year) from the date of purchase. Each pack you buy carries its own 12-month validity window starting on the date that pack was purchased.
  • Expiration: Any quota remaining at the end of the 12-month validity period expires and is forfeited. Expired quota cannot be restored, extended, or refunded.
  • Pre-expiry notice: For image translation packs, we will send a courtesy email notification approximately 30 days before a pack expires. We are not obligated to provide the same notice for search query translation packs, and the absence or non-delivery of any notice does not extend the validity period.
  • Quota previously purchased: Quota purchased prior to the effective date of these terms retains its original validity terms (no expiration).
  • Consumption: One unit of quota is consumed per image translation per target language, and per search query translation request (including requests served from our cache). Translations in your site's source language do not consume quota.
  • Non-transferability: Quota is non-transferable between accounts and has no cash value.

4. Machine Translation Disclaimer

IMPORTANT: READ THIS SECTION CAREFULLY

4.1 Translation Quality and Disclaimer

The Service employs a proprietary multi-tiered translation methodology designed to produce output that is materially more fluent, contextually appropriate, and natural-sounding than standard large language model output alone. While the Company does not warrant or guarantee the absolute accuracy, completeness, or fitness for any particular purpose of any translation, the Service utilizes advanced processing techniques, including contextual analysis, linguistic refinement, and quality verification layers, to deliver translations that substantially exceed the fidelity of unprocessed machine translation. Notwithstanding the foregoing, all translations are provided on an "as is" basis and may contain errors, omissions, or mistranslations.

4.2 Your Responsibility

You are solely responsible for:

  • Reviewing translated content for accuracy before relying on it
  • Ensuring translations are appropriate for your audience and use case
  • Any liability arising from translation errors or inaccuracies
  • Compliance with local laws regarding translated content
  • Obtaining professional human translation for critical content

4.3 Legal Content Exclusion

We attempt to automatically detect and exclude legal documents (Terms of Service, Privacy Policies, contracts, disclaimers, and similar legal text) from machine translation. However, due to the wide variety of site structures and rendering methods, automatic detection may not be reliable in all cases. We strongly recommend manually marking legal content using one of the following methods to ensure it is never translated. Machine-translated legal text may create liability issues and may not be legally binding.

  • Add the proxylang-no-translate class to the container element
  • Add the data-proxylang-no-translate attribute to the container element
  • Wrap content in <!-- @proxylang-do-not-translate-start --> and <!-- @proxylang-do-not-translate-end --> HTML comments

4.4 Brand Names and Proper Nouns

We attempt to preserve proper nouns, brand names, trademarks, and personal names unchanged during translation. However, this detection is not perfect, and you should review translations to ensure important names are preserved correctly.

5. Data Processing and Caching

To provide the Service, we temporarily process and cache your website content:

  • Edge Caching: Translated pages are cached at 300+ global edge locations for performance
  • Translation Cache: Individual translated strings are stored to avoid re-translation and improve consistency
  • Request Logging: We log request metadata (URLs, response times, languages) for analytics and debugging

5.1 What We Do NOT Do

  • Permanently store your original website content
  • Share your content with parties other than necessary translation providers
  • Use your content to train AI models
  • Access password-protected or authenticated areas of your site (unless explicitly proxied)
  • Modify your content in any way other than translation

6. Third-Party Service Providers

The Service utilizes the following third-party providers to deliver functionality:

6.1 PII Protection

Before sending content to translation providers, we automatically detect and redact personal information (emails, phone numbers, addresses, credit card numbers, etc.). Redacted content is replaced with placeholder tokens and restored after translation.

7. Content Ownership

7.1 Your Content

You retain all ownership rights to your original website content. Our translation of your content does not transfer any intellectual property rights to us.

7.2 Translated Content

Translations generated through the Service are derivative works of your original content. You own the rights to use these translations for your website. We retain a limited license to cache and serve translations solely for providing the Service.

7.3 Our Content

The Service, including our website, dashboard, APIs, documentation, and software, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse engineer our Service.

8. Acceptable Use

You agree NOT to use the Service to:

  • Translate content that infringes third-party copyrights or trademarks
  • Translate illegal content, including content promoting violence, terrorism, or hate
  • Translate adult/NSFW content without appropriate age verification
  • Distribute malware, phishing pages, or other malicious content
  • Impersonate other websites, organizations, or individuals
  • Generate SEO spam or manipulate search engine rankings
  • Process content from websites you do not own or have authorization to translate
  • Circumvent usage limits through multiple accounts or other means
  • Use our API to build competing translation services
  • Perform bulk translation of content not intended for website display
  • Interfere with the Service's operation or other users' access

9. Domain Configuration

To use the Service, you must configure DNS records for your domain. By doing so, you represent that:

  • You own or have authorization to configure the domain
  • You have the right to translate and distribute the content on that domain
  • Your use complies with your domain registrar's terms of service

10. Service Availability

We strive for 99.99% uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Third-party provider outages
  • Force majeure events
  • Security incidents requiring immediate response

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR DAMAGES ARISING FROM TRANSLATION ERRORS OR INACCURACIES

12. Indemnification

You agree to indemnify and hold harmless Proxylang and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit for translation
  • Claims related to translated content displayed on your website

13. Termination

Either party may terminate this agreement:

  • You: Cancel your subscription at any time through the dashboard
  • Us: Terminate or suspend your account for violation of these Terms, with or without notice

Upon termination, your access to the Service will cease, and cached translations will be purged within 30 days. You remain responsible for any fees incurred before termination.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Sending an email to your registered address
  • Displaying a notice in the dashboard

Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Seoul, South Korea.
